There was a motion to accept the minutes of the August 12th, 2010 meeting with 1 correction.  The motion was seconded and accepted with a vote of 6-0-0.

Mr. Nick Alfieri’s Agent’s Report has been appended to the minutes.


Public Hearing – Request for Determination – National Grid – Line Structure Replacement Project
Mr. Chris Kajesky, Wetlands Scientist of Louis Berger Group, and Ms. Amy McKinnon, Environmental Engineer of New England Power, both appeared before the Commission to discuss a line structure replacement project by National Grid.  Mr. Kajesky gave the Commission members an overview of the project and wetland descriptions and any possible impacts to these wetlands.  He also stated that there are no endangered species concerns with this project.  Swamp mats will be used in order to cross the wetland area to get the machinery to the work pad.

Ms. McKinnon presented the Commission with the proposed structure replacement activities, BMP’s and answered questions regarding the proposed work.

Mr. Alfieri questioned if there will be a tracking pad leading up to the swamp mats?  Ms. McKinnon stated that these will be used.

Mr. Alfieri recommended that no work be conducted during the Spring.

There was a motion to issue a Negative Determination subject to the 3 conditions that the work be performed according to the plan, that staff be notified when the work begins and when the work is completed.  The motion was seconded and accepted with a vote of 6-0-0.


Continued - Public Hearing – Amendment Request – 31 Hayward Street – Moseley Realty - CE159-928
Mr. Donald Nielsen, Engineer of Guerriere & Halnon, appeared before the Commission for an Amendment Request to Orders of Conditions for the installation of a playground.

Mr. Nielsen submitted a plan depicting Concept II-A with 2 minor changes and gave the Commission an overview of this plan.

Mr. Alfieri stated that all of his comments have been addressed and this plan, Concept II-A, is the plan that he recommends to the Commission to be the best option.

There was a motion to close the public hearing.  The motion was seconded and accepted with a vote of 6-0-0.

There was a motion to approve the Amendment to the existing Orders of Conditions for 31 Hayward Street with 1 special condition that the playground will be removed when the school vacates the site.  The motion was seconded and accepted with a vote of 6-0-0.


Continued - Public Hearing – Notice of Intent – Elm Street & Anchorage Road – Town of Franklin DPW – CE159-997
Mr. Ray Willis, Conservation Commission member, recused himself from this public hearing.

Mr. William Yadisernia, Town Engineer, appeared before the Commission for the reconstruction
of existing roadway and stormwater drainage system improvements.

Mr. Yadisernia submitted a revised plan depicting the revisions which were requested by the Commission at the last meeting; i.e., a north arrow reference, details on the rain gardens and a planting schedule.  Mr. Yadisernia provided the Commission with an overview of this plan.

Mr. Alfieri stated that he has no further comments regarding this project.  He recommends a special condition for his authorization to approve changes to the plant list.

Some special conditions discussed with the applicant were:  

  • permit adjustments to the planting schedule
  • non-installation of filter fabric depending on site conditions  
  • procedure of how the stone diaphragm will be cleaned out and maintained
  • prior to any maintainance activities, the Commission receive a written sequence of how it will be performed
.
Mr. Alfieri requested a special condition that gives him the latitude to make adjustments to the rain garden plant maintenance.  He also recommends that standard linear project conditions be a part of the Orders of Conditions.

There was a motion to close the public hearing.  The motion was seconded and accepted with a vote of 5-0-0.

GENERAL BUSINESS

        Minor Buffer Zone Activity:  40 Lorraine Metcalf Road
        The applicant has requested to install a 16’x24’ above-ground swimming pool.  Mr.       Alfieri informed the Commission members that he conducted an inspection of the stream   and determined that it is functioning as an intermittent stream.

        Mr. Alfieri also stated that the applicant has agreed to provide plantings for mitigation       and has agreed to place the plantings in whatever location the Commission requests.

        There was a motion to issue a Negative Determination subject to the conditions that the         work be performed according to plan, that the applicant notify staff when they begin    and complete the work and that there be no backflushing filter and no chlorine  sanitization and any shrubs planted as part of the landscaping plan conform to the Best         Management Practices Guidebook.

        The motion was seconded and accepted with a vote of 5-1-0; 5 Yes, 1 No, 0 Abstentions.
       
        Permit Decision:  300 Fisher Street – CE159-1000
        There was discussion among Commission members regarding the issuance of Orders  of Conditions for this project.  Mr. Alfieri suggested standard special conditions for the      Commission to append to the Order of Conditions.

        There was a motion to issue State and Local Orders of Conditions for the fencing project        at 300 Fisher Street.  The motion was seconded and accepted with a vote of 6-0-0.
